This KKAI consultant was called upon to investigate a serious injury motorcycle collision in which a motorcycle is reported to be traveling at high speeds and struck a passenger vehicle as it entered the roadway from a driveway. The motorcycle driver was severely injured when he was thrown from the motorcycle. The collision occurred on a winding wooded rural country road with very little traffic. Photographs without scene measurements were taken at the scene.
A forensic examination of the vehicles and scene along with the photographs taken at the scene of the collision provided evidence to determine the speeds of both vehicles at the time of the impact. The speed of the motorcycle was determined to be well under the speed limit, and the driver was taking evasive action to avoid the impact. The speed of the passenger vehicle was determined, and it was shown that the driver did not stop before entering the roadway from a blind driveway intersection.
Utilizing the speeds of the vehicles and the sight-lines for both drivers it was shown that if the driver of the passenger car had stopped before entering the roadway, the approaching motorcycle was visible and the collision could have been avoided. It was also shown that because the passenger car did not stop, the driver of the motorcycle took the proper evasive action but had no chance to avoid the impact.
It was determined from the forensic analysis that the motorcycle was not exceeding the speed limit or roadway conditions, and the driver of the passenger of the car failed to yield the right-of-way to the motorcycle.
