An electrical contractor took a contract from a general contractor for $9.3 million to completely replace all electrical components in a 44 story building on Park Avenue in New York City.
The contractor had never worked for the general contractor before, nor had he worked in New York, or with the local IBEW.
Needless to say, the electrical contractor had many strikes against him from the start, including an almost impossible schedule and looming penalties if tenant leases were not upheld.
When the situation worsened, the general contractor looked to the electrical contractor for resolution. The electrical contractor’s insurer quickly recognized that the electrical contractor would be unable, under any conditions, to finish the job. The consultant, hired by the insurer, solicited fixed price bids from IBEW contractors, but no one wanted the mess that was in place.
The consultant and the insurer then put in place a time and material agreement with an electrical contractor. The consultant became the electrical construction manager, made payments to sub-contractors and suppliers in the amount of $1.85 million, monitored payroll, made payments to IBEW, supported the insurer in their claims against the original electrical contractor.
Unfortunately, the losses to the insurer ended up being approximately $6.6 million and the insurer was unable to re-coup from the original electrical contractor.
